1. Who we are
PhoneCloudify is operated by PhoneCloudify Labs Ltd., a company registered in Hong Kong SAR, with registered office at Unit 1108, 11/F, Tower 2, Silvercord, 30 Canton Road, Tsim Sha Tsui, Kowloon, Hong Kong. In these terms "we", "us" and "PhoneCloudify" mean PhoneCloudify Labs Ltd.; "you" means the person or entity using the service.
2. What we provide
We provide remote access to Android computing devices ("cloud phones"), sell configured Android hardware, and provide associated software including identity management, network routing and automation tooling. Service specifications are those published on this site at the time of your order.
3. Your account
You are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old and legally able to enter into contracts. One person or entity per account; sharing an account across unrelated businesses is not permitted.
4. Acceptable use
Your use of the service is governed by our Acceptable Use Policy, which forms part of these terms. Breach of that policy may result in immediate suspension without refund. We enforce it: approximately 340 accounts were terminated for violations in 2025.
5. Fees and payment
Cloud plans are billed in advance, monthly or annually, in cryptocurrency through our payment provider. Metered usage is billed against a prepaid balance. Hardware is charged in full at order. Prices are quoted in US dollars; the crypto amount is calculated at the exchange rate at invoice creation and is fixed for the invoice lifetime.
Failure to pay results in suspension after 3 days and termination after 30 days. Identities are retained for 60 days from termination and then permanently destroyed.
6. Service levels
We target 99.9% monthly availability for device provisioning and streaming. Enterprise customers may purchase a contractual SLA with service credits. Availability excludes scheduled maintenance announced at least 48 hours in advance, and events outside our reasonable control.
7. The Ban Shield guarantee
For Growth and Scale plans, if a social media account created on an PhoneCloudify device is disabled within 30 days of creation as a result of a device or network signal, we will credit the device month and rebuild the identity at no charge. This does not apply to enforcement arising from content, conduct, third-party reports, payment issues, or changes in platform policy. Our determination of cause is based on our forensic telemetry and is final. The guarantee is a service credit and is not a warranty that accounts will not be disabled.
8. Intellectual property
We retain all rights in the service, PhoneCloudifyOS, our software and our documentation. You retain all rights in your data and content. You may not reverse engineer, resell or sublicense the service without written agreement.
9. Your data
We process your data as described in our Privacy Policy. We do not inspect application traffic, log screen content or read message bodies. You may export your data at any time.
10. Liability
To the maximum extent permitted by law, our aggregate liability arising from the service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for lost profits, lost accounts, lost data or indirect loss. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be limited.
11. Termination
You may cancel at any time from the console; service continues until the end of the paid period. We may terminate for breach of these terms or the Acceptable Use Policy, or on 30 days' notice for any reason, refunding any unused prepaid balance.
12. Changes
We may update these terms. Material changes are notified by email at least 30 days in advance. Continued use after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of Hong Kong SAR. Disputes are subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
